Insurer Loses Motion to Dismiss Claim by Duluth homeowner

A Minnesota District Court trial judge in Duluth has ordered a property & casualty insurance company to cover a Duluth man's property damage resulting from city water main break a week before Christmas, 2013. Coverage for more than $20,000 in damage to the home and its contents from water flowing into the home from the broken water main was denied by the insurer. The Duluth homeowner retained attorney Jim Balmer, who first brought an action against the City of Duluth for the damage. When that claim was dismissed on immunity grounds by the Minnesota District Court, Jim brought suit against the insurer, contending the policy afforded coverage for this sort of loss.

MN Workers Compensation claim upheld by WCCA

A young Duluth area woman injured while on the job in Wisconsin has had her award of compensation by the workers compensation trial judge upheld by the Minnesota Workers Compensation Court of Appeals.  Hired in Duluth by a national company, the woman sustained a low back injury while on the job in Superior, Wisconsin, one of the sites her duties required her to work.  The employer denied the claim, initially because it contended her injuries were aggravated by a fall away from work.

Successful appeal of dismissal of injury claim against West Duluth tavern

jim-balmer.jpgJim Balmer is happy to announce a successful appeal of the dismissal of his client's claim against a West Duluth tavern.  Jim's  client suffered a broken leg in a fracas at the tavern December 28th, 2013, resulting in costly medical procedures, prolonged disability and associated wage loss from his construction job.  The fight erupted between some other members of the client's group and other customers.  The client was injured while trying to protect his spouse from injury in the melee.
